January 1, 2027 (effective date): New York’s RAISE Act (signed December 2025) will require frontier AI developers to publish safety frameworks and report critical incidents within 72 hours—stricter than California’s 15-day window—with an oversight office within the Department of Financial Services. Penalties: up to $1M for first violation, $3M for subsequent violations.
February 1, 2026: Colorado’s SB 24-205 went live, requiring US lenders to disclose how AI makes credit decisions—data sources, evaluation methods, bias mitigation evidence. California and Illinois followed with similar mandates for high-risk AI in consequential decisions.
August 2, 2026: The EU AI Act’s high-risk AI requirements take effect across 27 member states. Financial institutions must demonstrate explainability, transparency, human oversight, and ongoing monitoring—or face enforcement by national market surveillance authorities.
Add FINRA’s 2026 guidance that agentic AI needs the same supervisory rigor as human processes, and the UK’s FCA extending personal accountability to Senior Managers for AI oversight under SM&CR, and you have a regulatory environment that demands evidence, not intentions.
The strategic insight: New York and California—representing the two largest financial centers in the US—have created a de facto national AI safety standard. OpenAI and Anthropic both expressed support for this alignment, with OpenAI’s Chief Global Affairs Officer stating that having similar legislation in two large state economies “is a big step in the right direction.” For financial institutions, this means the floor for AI governance just got significantly higher.
